The Division I Infractions Appeals Committee reviews appeals of determinations made by the Committee on Infractions. Its focus is on the record as originally presented. Appeals are not new hearings and typically do not consider new evidence, except in very limited circumstances.

Key Responsibilities
- Evaluate appeals related to factual findings, conclusions, violations, case level or classification, core penalties (outside specified ranges) and additional penalties.
- Consider appeals of underlying violations that support head coach responsibility findings when such arguments were initially presented.
- Stay (temporarily suspend) penalties during the appeal process if a Notice of Intent to Appeal is filed within 15 calendar days and includes a request to stay specific penalties.
- Resolve appeals primarily via written record review. Oral arguments are rare and used only when necessary.
- Apply a rigorous standard of review. Uphold findings and penalties if the original decision is reasonably supported by the record, and overturn only if no reasonable person could have reached the initial outcome.

It is included in the 2022-23 annual report because it was the last case decided under the prior infractions appeals process and standards. The new infractions appeals process went into effect for all appeals submitted after Jan. 1, 2023.

Infractions Appeals Committee Timeline
The average Infractions Appeals Committee case takes eight months from the time of appeal until a resolution is reached. These time frames represent legislated benchmarks:
Start: Committee on Infractions Decision.
15 Days: Parties declare intent to appeal.
30 Days: Deadline to file written appeal.
30 Days: Committee on Infractions response to written appeal due.
14 Days: Deadline for parties to file rebuttal.
10 Days: NCAA enforcement staff submits materials after rebuttal.
10 Days: Appellant response to enforcement due.
1-2 Months: Oral argument held in front of the Infractions Appeals Committee (if applicable).
6 Weeks: Infractions Appeals Committee releases its decision.
